Silent Auction Terms & Conditions
11 Original etchings by Salvador Dali
To be sold separately at the Manawatu Art EXPO 2024

By participating in this silent auction, you are deemed to accept the below Terms and Conditions and to have agreed to be bound by them.

1. Promoter: The promoter of this promotion is The Feilding and Districts Art Society Limited (“The Art Centre”, ”FADAS”, “we”, “our”, “us”).

2. Eligible Entries: (a) To be eligible to participate in this silent auction promotion, you must be a NZ resident that is 18 years or over.

3. Ability to Exclude: The FADAS reserves the right, in its sole discretion, to exclude any person from participating in the silent auction promotion on reasonable grounds.  

4. Auction Period: The Auction commences from announcement at the Manawatu Art EXPO opening, from 5.30pm on Thursday July the 18th 2024,  and ends at 2pm on Sunday the 21st of July 2024.  Bidding will continue for any of the 11 art works on auction, until no further bids have been received for 2 minutes.

5. How to Enter: To enter, please register your interest on our website following the registration link (below) or by filling out the bid form at the Manawatu Art EXPO before 1pm on Sunday the 21st of July. Bids can be placed at the Manawatu Art Expo, by text or by phone call – a number will be provided to those registered.

6. Auction Packages:  There are 11 separate silent auctions. One for each original etching by Salvador Dali. The works, their provenance and a summary of the works will be displayed at the Manawatu Expo for the duration of the event. A copy of the summary for any of the works being auctioned can be requested in your registration, at the Manawatu Art Expo or by email to info@feildingartsociety.com

7. Winning an Auction:  (a) The winner of each auction will be the entrant who submits the highest Auction Bid above a pre‐set reserve price for each of the Dali artwork. If there are no bids or the bids are under the reserve amount the work will not be sold.

(b) Each winner will be contacted, if the are not at the Event on 21st of July, by telephone via the details provided in the Auction Bid and/or registration.

(c) The Feilding Art Centre will issue to the successful bidders, a tax invoice to the value of the winner’s Auction Bid (“Tax Invoice”).

(d) On payment of the Tax Invoice, the Artwork can be collected from the Manawatu Art Expo before 5pm on Sunday the 21st or from the Feilding Art Centre, 104 Manchester st, Feilding, there after by appointment.

(e) If for any reason a winner is unable to be contacted within 72 hours of the end of the Auction Period, or if a winner does not pay the Tax Invoice, or if they otherwise breach these Terms of Conditions, the entrant with the next highest Auction Bid will become the eligible winner of the Dali artwork.  

(f)the Feilding Art Centre reserves the right to refuse a winning bid from an entrant who the Feilding Art Centre decides, in its sole discretion, has violated these Terms and Conditions, gained unfair advantage or won using fraudulent means.  

8.Disputes: If a dispute arises concerning any aspect of the competition (including eligibility), The Feilding and Districts Art Society’s decision will be final.  

9. Additional Terms: (a)The winner is responsible for all insurance, or other costs that may be associated with purchasing the Art Works including postage.  

(b) The winner takes the Art Work entirely at their own risk as works are sold as they are.

 (c)To the fullest extent permitted by law, the Feilding Art Centre and its directors, officers and employees will not be responsible for any loss, damage or personal injury arising directly or indirectly or in connection with this promotion or winning of our Dali art work auction.  

(d)Any personal information collected and stored as part of the competition will be in accordance with the Privacy Act 2020.

(e)The Feilding Art Centre reserves the right to amend, suspend or terminate the competition and these Terms and Conditions at any time.  

(f)Failure by the Feilding Art Centre to enforce any of its rights at any stage does not constitute a waiver of those rights.

(g) These Terms and Conditions are governed by the laws of New Zealand.
